Sortmedia Ltd. organizes chance games and cash prizes, holidays and other consumer items draws and, on occasions, also real estate. This is done via their web page at www.sorteoo.com
In order to participate, you must register as a member of Sorteoo.com. Registration is free. The goods shown on the website do not form a public offer.
With your registration and participation in one of the draw games, you accept as a registered member the following general terms & conditions:
1. Lotteries
1.1 A member may register free of charge. Afterwards, the member must complete the skill game. With a total of 5 correct answers, the member obtains the right to acquire a coupon of their choice. Participation in any one game depends solely on skill. The member may recharge their account in order to pay the corresponding amount for each game or participation. In order for a member to participate in a game, they must pay the corresponding fee published for each participation. The skill games are similar to those seen on TV where general knowledge questions are asked. The participant has five minutes to answer five questions correctly. If the participant answers the questions correctly, they have the right to participate in a prize draw. The amount of tickets per game is determined and limited. Sortmedia Ltd. reserves the right to modify the duration of the game time. The tickets are valid if the participant has answered all questions correctly and has paid the corresponding amount to the Sortmedia Ltd. account. The winner is announced following a draw from all the valid tickets witnessed before a notary public. Should technical and local possibilities permit, the draw will be transmitted live via webcam.
1.2 All the articles, objects and or services offered by Sorteoo.com are published on the web page. Publications and descriptions may vary in detail from the real goods.
1.3 A draw will end when the number of tickets run out, or at the latest on the published draw date .If all of the tickets for a draw are not sold, the right to win a certain prize (according to draw description) will be converted in to a cash prize. The winning amount is obtained and calculated based upon the amount of tickets sold until the date of draw, less 30% administrative cost. The winning amount is split three ways: 1st Prize = 50% of the winning amount; 2nd Prize = 35% of the winning amount; 3rd Prize = 15% of the winning amount. Purchased participations cannot be reimbursed. The cash amounts are shared between the participants of that specific draw. Prior to the draw, all participants are advised of the specific method, i.e. prize draw or cash prizes. The drawing of the winner will take place under the supervision of a notary.
1.4 The prize is drawn between all participants who have obtained their ticket after having delivered correct answers to all questions and participants who have fulfilled the terms and conditions, including having received from Sorteeo.com a confirmation in the form of a participation number. This confirmation number is received via email and can also be seen in “My SorteoO”. The draw will take place no longer than a week after the game has ended, whether by elapse of the established time period, or when all tickets have been sold. For eventual compensations for payments made to the participants’ accounts, an administration fee is applied. The winners will be advised immediately via email. The winners will be announced in “my SorteoO”.
2. Participation in Chance Games & Lotteries
2.1. Only participants aged 18 years of age and over can be accepted. People residing in a country where taxes on the advertised goods above and beyond the normal value added tax (up to 20% max.) i.e. a “luxury tax”, cannot participate.
2.2. Participation in a draw depends on correct answers respectively the participant’s knowledge of the subject. There is no legal right to participate. The money is transferred in the member’s account by means of online payment systemShould the ticket be paid via a bank transfer (after having answered the questions correctly) the order of receipt of payment will determine the validity of the ticket. When all payments have been received within the account, the tender is closed (any payment received late shall be paid in to the member’s account and can be used for future draws). Refund of purchased tickets are only carried out via this option.
2.3. The participant has the right to acquire additional tickets until the end of the draw by answering (new) questions. Purchase takes place online via personalised access to “my SorteoO”. Acquired tickets are shown in the corresponding member’s account.
2.4. Legal proceedings are excluded.
3. Obligations of the participant
3.1. Each participant is aware of these types of games (a combination of change games and luck) which may not be permitted in all countries. Each participant is obliged to verify whether or not the participation or winning of such a game might lead to any legal consequences in their place of residence. Sortmedia Ltd. does not guarantee in the case of any law infringement in the place of residence of the winner that the prize can be obtained and/or kept.
3.2. The participant agrees to participate in accordance with the terms and conditions established by SorteoO.com. The use of technical aids or any other measures with the purpose of manipulating the game are not permitted. The use of any such measures authorizes Sortmedia Ltd. to exclude the participant.
3.3. The member or participant assures not to distribute or claim contents that may contain a criminal consequence or infringe the rights of a third party (especially making reference to commercial or competition brands). Above all, it is forbidden to distribute dangerous contents for youngsters, child pornography, racism or extremist content, virus attacks, chain letters and bad use of the SorteoO.com services in order to access the security measures of other webs, hosts or accounts (cracking, hacking, Denial of Service Attacks). Practice of any of the aforementioned authorizes Sortmedia Ltd. to cancel with immediate effect the contract and to block all contents of said member/participant.
3.4. The participating member waives any responsibility of Sortmedia Ltd that may arise as a result of its acts (previously detailed). The member is to notify Sortmedia Ltd. immediately of any incorrect use by a third party of the services and web of SorteoO.com.
3.5. Sortmedia Ltd. has the right to irrevocably exclude a participating member from draws without prior notification and without explanation. Should the result of such infringement generate the winning of a prize, Sortmedia Ltd. reserves the right to deprive the participant of such prize and claim it. In the case in which the participant no longer has the prize, the organizer has the right to claim the value of said prize. Each disadvantage or prejudice as a resulting for both the participating members and/or Sortmedia Ltd. shall be at the expense of the participant held responsible.
4. Prizes
4.1. All profits are always provided to the winner at his place of residence, free of charge and transportation costs. However, Sortmedia Ltd., preserves the right to deliver the winnings at another location; any additional costs incurred due to this change of delivering location, will be borne by Sortmedia Ltd..
In the case where a vehicle is won, both the vehicle itself and it’s respective documentation are delivered to the winner. The vehicle registration is to be applied for by the new owner (winner of the vehicle). Details are available in each draw.
All other expenses and taxes incurred in connection with the delivery of a prize are the winner’s responsibility.
In the case of real estate, the handing over of the prize takes place via a title deed. It is not necessary to use the same notary as the one who attended the draw. The real estate is handed over to the winner free of encumbrances.
4.2. When prizes are in the form of objects/articles, all future & additional costs are to be borne by the winner. The distribution of the prize objects shall be carried out through Sortmedia Ltd., the proprietor or dealer, who hold on to the prize for up to eight weeks. All prize objects are the property of Sortmedia Ltd. or the corresponding proprietor up until the end of the draw. Should the winner not collect their prize within the established period of time, their right towards the prize shall irrevocably expire along with any right that the winner may have against Sortmedia Ltd..
4.3. The transfer of the winners rights against Sortmedia Ltd. shall not be authorized without the prior consent of Sortmedia Ltd..
4.4. Sortmedia Ltd. reserves the right to produce a prize equal to, similar to or of the same value in the case that the article published was not available or if it can only be delivered under great effort.
4.5. All winnings that can be sent through the postal service will be delivered from partners on behalf of Sortmedia Ltd... Winnings, which cannot be shipped by conventional means, will be sent to the winner through a shipping company or special services.
4.6. In case of cash prizes, the amount will be transferred to an account of the winner's choice. The winner shall bear the bank fees for the money transfer. Sortmedia Ltd.. is entitled to remit all statutory withholding taxes directly to the competent authorities. If there has to be a conversion from Euros into another currency, will the winner will bear the costs thereof. The applicable exchange rate is whatever the prevailing rate of exchange is on the date of transfer. All taxes and fees incurring in their home country or the country of his choice, are the winner’s responsibility.
5. Responsibilities
5.1.SorteoO.com is dependent upon various providers and cannot guarantee the availability or running of its systems at all times. Sortmedia Ltd. cannot be held responsible for any damages that may result from a non availability of such services with the exception of negligence or intent. The organization assumes any legal responsibility due to infringement which may put health at risk, or the integrity or life of the participant. An eventual right to compensation is limited to the value of the winning prize with the exception that a legal condition removes such limitation.
5.2.Sortmedia Ltd. excludes itself completely from the transfer of the content of it’s web pages at SorteoO.com directly or indirectly and does not hold themselves responsible for the publication of the content of the pages, the organizers of the these are responsible.
5.3. Sortmedia Ltd. hands over to the winner any possible guarantee against the manufacturer or distributor in reference to a particular prize. The winner accepts this transfer when accepting the prize and Sortmedia Ltd. excludes itself from any responsibility in relation to the guarantee of the product and can only be held responsible in the case of mandatory law.
6. Exclusion from participation
6.1. Sortmedia Ltd. has the right to exclude participants, even after the draw, for important reasons. An important reason would be that a participant had terminated their membership and registration with SorteoO.com with immediate effect or if the participant has not fulfilled any of the general terms and conditions or their respective obligations as a member or participant or should they endeavuor to manipulate or influence the game or even disturb the running of the game.
6.2. Claims on behalf of members or participants due to exclusion shall not be accepted.
7. Data protection
7.1. Data required in order to participate in the draws and lotteries is stored within the SorteoO.com database system. Forwarding of information to a third party shall only take place when in relation to the running of the lottery or the delivery of prizes thus the details are only passed on to a third party if it is indispensable for the good running of the game and when required for the delivery of the winning prizes. Sortmedia Ltd. assures that the information received is treated confidentially.
7.2. With the purchase of a participation, the participant expresses their agreement that their details be stored within the SorteoO.com database and that should they become a winner, then their name and place of residence shall be published on the web page, should they have not prior to this expressed their disagreement via email immediately after having been notified of their winning status.
8. Modification of the general registration terms and conditions
8.1. Sortmedia Ltd. reserves the right to change their general registration terms and conditions at any time without giving any reason or without prior communication to the members. The changes are implemented with immediate effect, unless otherwise mentioned.
